The Infrastructure Investment & Jobs Act (IJA) was passed by Congress and signed into law on November 20, 2021, including the Carbon Capture Improvement Act (S.1829) which established eligibility for CCUS and DAC technologies to receive private activity bond (PAB) financing under the tax-exempt provisions of Internal Revenue Code Section (IRC) 142. Section 146 provides that PABs for qualified carbon dioxide capture facilities can receive a 75% exemption from the state volume cap.
